1. Acceptance of Terms

By accessing or using Buktika, you agree to these Terms. These apply to farmers, landowners, Viridians, community members, service providers, and visitors.

Important: These Terms are legally binding. By using the Platform, you accept these Terms and our Privacy Policy.

2. About Buktika

Buktika is a restoration funding platform connecting responsible buyers with farmers for evidence-based restoration. We operate internationally, currently focused in South Africa.

2.1 Our Mission

When Nature Heals, Our Dignity Grows. Payment follows accepted proof. Farmers keep title and control.

2.2 Core Principles

3. HEKTO Token

3.1 Purpose

Target settlement reference: 1 HEKTO = 100 uUSD (operational budgeting reference). HEKTO funds restoration work, not speculation.

Not Investment: HEKTO is a utility token for restoration funding only, not a security or speculative asset.

4. User Responsibilities

4.1 Wallet Security

You are responsible for private keys. Buktika cannot recover lost keys. Never share private keys.

4.2 Accurate Information

Provide truthful information. Fraud results in suspension and legal action.

4.3 Legal Compliance

Comply with all applicable laws including:

Environmental protection laws
Tax obligations
AML regulations
KYC requirements
Land use laws

5. Restoration Programmes

5.1 Programme Structure

Buktika operates restoration programmes using modular framework (M1–M8) with specific acceptance criteria and payment triggers.

5.2 Evidence-First Rule

Payment follows accepted proof. Acceptance gates verify evidence against published criteria.

5.3 Landowner Rights

Keep full title and control
Payment for accepted work only
Grant access per agreements
Continue lawful farming in designated areas

6. Viridians

6.1 Funding

Viridians fund programmes via HEKTO. Funds release only upon acceptance of verified evidence.

6.2 Claims

Verified outcomes packaged as HektoBags with seven-year evidence retention. Claims must follow published policy.

7. MamaDEX

7.1 Consent

All activities require informed consent. Names and photos shared only with permission.

7.2 Payments

Payments flow directly to Fellows, not through landowners.

7.3 Employment

Fellows assist with measurement and learning. No employment relationship created.

8. Prohibited Activities

You may NOT:

Engage in fraud or deception
Manipulate evidence
Submit false documentation
Money laundering
Environmental law violations
Weapons on sites (except authorised)
Interfere with security

9. Account Termination

9.1 Our Rights

We may suspend accounts for violations, fraud, sanctions failure, false info, or misuse.

9.2 Effect

Termination does not affect accrued rights including payment for accepted work.

11. Intellectual Property

All Platform content is property of Buktika or licensors. Do not copy, modify, or distribute without permission.

12. Data and Privacy

See our Privacy Policy. We operate security aligned with ISO/IEC 27001 and 27701.

Evidence stored with SHA-256 integrity hashes.

13. Dispute Resolution

13.1 Governing Law

Jurisdiction-agnostic. Specific law and dispute resolution per applicable programme agreement and local law addendum.

13.2 Process

Good faith discussion
Arbitration per programme agreement if unresolved

13.3 Class Action Waiver

Individual disputes only. No class actions where permitted by law.

14. Changes

We may amend Terms with 30 days notice via Platform notification, email, or public posting.

Continued use constitutes acceptance.

15. Severability

If any provision is found invalid, the remainder stays in force.

16. Entire Agreement

These Terms, Privacy Policy, and programme agreements constitute the entire agreement.
